Technology Terms & Conditions (Terms of Use)

These Technology Terms & Conditions (“Terms”) govern your access to and use of the Workhorse Hauling website, any online forms, landing pages, booking/request tools, and any related digital services (collectively, the “Site”), as well as any communications you receive from us by email, phone, or text message. The Site is owned and operated by Workhorse Hauling (“Workhorse Hauling,” “we,” “us,” or “our”).

By accessing or using the Site, submitting information through the Site, requesting services, or opting in to receive communications from us, you agree to these Terms. If you do not agree, do not use the Site.

These Terms are incorporated into our Privacy Policy and should be read together with it.

1. Who We Are / Services

Workhorse Hauling provides hauling, junk removal, and related services. Information on the Site is provided for general informational purposes and to allow you to request quotes, schedule service, or contact us.

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Site or submit requests for services. By using the Site, you represent that you meet this requirement.

3. Service Requests, Quotes, and Scheduling

Submitting a request through the Site does not guarantee service availability. Quotes provided through the Site or via communications are estimates and may change based on job scope, access, material type, disposal requirements, and other conditions discovered during service.

4. User Content and Accuracy of Information

If you provide information through the Site (including through contact forms), you agree that:

  • the information is accurate and up-to-date to the best of your knowledge, and

  • you will not submit unlawful, harmful, or misleading content.

We may rely on the information you provide to contact you and to deliver services.

5. Acceptable Use

You agree not to:

  • attempt to gain unauthorized access to the Site or its systems,

  • interfere with or disrupt the Site or servers,

  • submit spam, deceptive requests, or automated form submissions,

  • upload or transmit malicious code, or

  • use the Site in violation of any applicable law.

7. Text Messaging (SMS) Terms

If you provide your mobile number and opt in to receive text messages from Workhorse Hauling, the following terms apply:

7.1 Consent to Receive Messages

By opting in, you authorize Workhorse Hauling to send you text messages (SMS/MMS) at the number you provide. Messages may include (as applicable):

  • service and appointment coordination

  • updates related to a quote or job request

  • customer support and account-related messages

  • promotional or marketing messages (only if you separately opt in where required)

Consent is not a condition of purchase.

7.2 Message Frequency

Message frequency will vary based on your interaction with us, including service requests, scheduling, and support needs.

7.3 Message and Data Rates

Message and data rates may apply depending on your wireless carrier and plan.

7.4 Opting Out

You can opt out at any time by replying STOP to any message. After you send STOP, you may receive one final message confirming your opt-out.

For help, reply HELP to any message, or contact us using the information in the “Contact Us” section below.

7.6 Supported Carriers / Delivery

Wireless carriers are not liable for delayed or undelivered messages. Delivery is subject to effective transmission from your carrier and device.

7.7 Mobile Information Sharing

No mobile information will be shared with third parties/affiliates for marketing/promotional purposes.
All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

7.8 Changing Your Number

If your phone number changes, you agree to notify us so we can update our records. Opt-out requests apply to the number from which they are sent.

8. Third-Party Links and Services

The Site may contain links to third-party websites or services. We do not control those sites and are not responsible for their content, policies, or practices. Use of third-party sites is at your own risk.

9. Disclaimers

The Site is provided on an “AS IS” and “AS AVAILABLE” basis. To the fullest extent permitted by law, Workhorse Hauling disclaims all warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the Site will be uninterrupted, secure, error-free, or free of viruses or other harmful components.

10. Limitation of Liability

To the fullest extent permitted by law, Workhorse Hauling will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from or related to your use of the Site or communications with us.

If any liability is found, Workhorse Hauling’s total liability for claims relating to the Site will not exceed the amount you paid to us (if any) for the specific service giving rise to the claim.

11. Indemnification

You agree to indemnify and hold harmless Workhorse Hauling and its affiliates, officers, employees, and service providers from any claims, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising out of your misuse of the Site, violation of these Terms, or violation of any law or third-party rights.

We may update these Terms at any time. Updates are effective immediately upon posting on the Site. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of the State of Ohio, without regard to conflict of law principles. Any disputes will be brought in the appropriate state or federal courts located in Ohio, unless otherwise required by applicable law.
